When they were married, Walsh-Smith signed a prenuptial agreement giving her the couple's home in Florida and $500,000 a year in the event of a divorce (or his death), but with the bulk of his estate going to his daughters. In 2007, Philip Smith filed for divorce, which was immediately contested by Tricia who felt there were no grounds for a formal separation.

On April 10, 2008, Tricia Walsh-Smith posted the home made video called Poor, vulnerable Tricia on YouTube about her relation with her husband regarding her divorce as an "'act of revenge from a scorned psychotic ex". Standing in the Park Avenue apartment Walsh-Smith claims that her husband Philip Smith hopes to have her removed from their apartment within 30 days due to a clause in their prenuptial agreement, Walsh-Smith explains that her 74-year-old husband is "25 years older than [she]", that she is "about the same age as his two daughters", and that he wants to leave his fortune to them. She then proceeds saying that they never had sex, and that she recently found a stash of the erection enhancing drug Viagra, condoms and pornographic movies. Midway through the video, Walsh-Smith decides to call her husband and clue him in on her production. He's on another call. His secretary offers to take a message. The video closes with a message stating: "Will poor vulnerable Tricia be evicted, or will her mean, bad husband do the right thing? Stay tuned."

Though it seems Walsh-Smith wants to get the agreement she signed thrown out, she also claims that there are no grounds for divorce, as New York does not have a no-fault divorce law, and marriages can be ended only for cause. In the video, Walsh-Smith presents her case, complete with facts about the couple's lack of a sex life, which is grounds for divorce in the state of New York. However, the six-minute YouTube video may also provide her husband with ample grounds for divorce in the state of New York. Walsh-Smith has been represented by a series of divorce lawyers, the latest of which was Raoul Felder, who explained that his ex-client was "acting out of passion." He also called the prenuptial agreement she had signed with her husband "stupid," but he, like her other attorneys, could not seem to work with her. Felder said "I was her third lawyer. I just sent her a letter telling her I was off the case."

Philip Smith's lawyer, David Aronson, of the top New York matrimonial boutique firm, Sheresky, Aronson, Mayefsky,& Sloan, called the video "appalling" and said that "Mr. Smith is hurt and disappointed that Mrs. Smith has done this, but he is a private person who does not believe it would be in anyone's interest to respond to what she has done in a public forum." On April 22, 2008 Walsh-Smith temporarily removed the video from YouTube, only to put it back up again three days later.
